1. Acceptance of Terms

By accessing or using Epromptly ("the Service", "we", "us", or "our") accessible via epromptly.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of the Service

Epromptly is an AI prompt generation, enhancement, and optimization platform designed to refine instructions for large language models (such as ChatGPT, Claude, and Gemini) and image generation systems. Features include text generation, prompt rewriting, voice transcription, image reverse-engineering, and curated prompt templates.

3. User Accounts & Registration

Account Creation: You may register using Google OAuth or by providing an email and password.
Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Accuracy: You agree to provide accurate and current account information.

4. Free Tier & Fair Usage

Epromptly provides a free service tier granting up to 30 free prompt enhancements per day (resetting every 24 hours). The free tier is supported by third-party advertisements and sponsor messages. Automated scraping, abuse, or intentional evasion of daily rate limits is strictly prohibited.

5. Pro Subscriptions, Free Trials & Payments

Subscription Plans: We offer premium subscriptions, including Pro Monthly ($4.00/month) and Pro Yearly ($39.00/year), granting unlimited prompt generations, zero advertisements, priority response speeds, and custom persona memory.
7-Day Free Trial: Subscriptions may include a 7-day free trial. If you do not cancel before the trial period ends, you will be automatically billed the agreed subscription amount for the subsequent billing cycle.
Merchant of Record: Payment processing, invoicing, and tax handling are managed by our Merchant of Record partner, Creem (creem.io).
Cancellation: You may cancel your subscription at any time. Your Pro benefits will remain active until the end of the current paid billing period.

6. Intellectual Property & Content Ownership

Your Content: You retain full ownership of the inputs, drafts, and text you provide to the Service. Epromptly claims no intellectual property rights over the prompts you generate.
Epromptly IP: The Epromptly logo, website design, user interface, templates library, and software code are the proprietary property of Epromptly and protected by applicable copyright and intellectual property laws.

7. Prohibited Uses

You agree not to use the Service to:

Generate abusive, illegal, harassing, defamatory, or harmful content.
Attempt to reverse-engineer, decompile, or disrupt our backend infrastructure and Cloudflare Workers.
Deploy automated bots, scrapers, or scripts without prior written authorization.

8. Disclaimer of Warranties & Limitation of Liability

The Service and AI-generated outputs are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for optimal prompt accuracy, large language models can occasionally produce unexpected or inaccurate results. Epromptly shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the Service.

9. Third-Party Services & Advertising

The Service integrates with third-party providers including enterprise cloud AI infrastructure providers, Google AdSense, and Creem Payments. Your use of these integrated features is subject to the respective privacy policies and terms of service of those third parties.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Continued use of the platform following any modifications constitutes acceptance of the updated terms.
